{"id":1858,"date":"2013-11-15T08:33:41","date_gmt":"2013-11-15T13:33:41","guid":{"rendered":"https:\/\/www.beyondmommying.com\/blog\/?p=1858"},"modified":"2014-03-05T20:34:40","modified_gmt":"2014-03-06T01:34:40","slug":"proper-use","status":"publish","type":"post","link":"https:\/\/www.beyondmommying.com\/blog\/2013\/11\/15\/proper-use\/","title":{"rendered":"Proper Use"},"content":{"rendered":"<p>I didn\u2019t want to go there a few days ago, but now I do.\u00a0 Add it to the\u00a0<a href=\"https:\/\/www.beyondmommying.com\/blog\/2013\/11\/13\/teary-eyed\/\">\u201cTeary-eyed\u201d<\/a>\u00a0list: I\u2019ve almost cried (many times) recently because I saw a child improperly restrained in the car.\u00a0 I\u2019m not talking about the chest clip being too high or even a 1 year-old forward facing.\u00a0 I\u2019m talking about things like a 1 year-old in a forward facing car seat and not harnessed in (making me wonder if the seat was attached to the car).\u00a0 Things like a no older than 3 year old standing up between the front seats pulling into the parking lot at Sugarplum&#8217;s gymnastics.\u00a0 Things like seeing the back of a 7-8 year old child\u2019s head again the window as I went 70 mph down the Florida Turnpike.\u00a0 Things like a baby facing forward in an infant\/bucket seat that is made to only face backwards.<\/p>\n<p>I\u2019ve already argued best practice in\u00a0<a style=\"line-height: 1.7;\" href=\"https:\/\/www.beyondmommying.com\/blog\/2013\/02\/21\/car-seat-fanatic\/\">&#8220;Car Seat Fanatic&#8221;<\/a><span style=\"line-height: 1.7;\">\u00a0and\u00a0<\/span><a style=\"line-height: 1.7;\" href=\"https:\/\/www.beyondmommying.com\/blog\/2013\/07\/27\/continuing-car-seat-safety\/\">&#8220;Continuing Car Seat Safety&#8221;<\/a><span style=\"line-height: 1.7;\">.\u00a0 I\u2019ve also argued physics and physiology in \u00a0<\/span><a style=\"line-height: 1.7;\" href=\"https:\/\/www.beyondmommying.com\/blog\/2013\/10\/16\/the-reality-of-child-restraints\/\">&#8220;The Reality of Child Restraints&#8221;<\/a><span style=\"line-height: 1.7;\">. \u00a0<\/span><span style=\"line-height: 1.7;\">Maybe those things can be ignored, so I\u2019ll provide one more argument for how important child passenger safety is: legalities.<\/span><\/p>\n<p>Each state in the US has its own specific child passenger safety laws (which can be found at <a href=\"http:\/\/www.ghsa.org\/html\/stateinfo\/laws\/childsafety_laws.html\">http:\/\/www.ghsa.org\/html\/stateinfo\/laws\/childsafety_laws.html<\/a> or you can google \u201cchild passenger laws in ___\u201d to find your specific law).\u00a0 While many laws are far below the standards of what is considered best practice, such as the National Highway Traffic Safety Administration\u2019s recommendation to rear-face children as long as possible and to use a convertible seat rear facing if the child meets the rear facing requirements, they non-the-less are the laws of the lands and must be followed.<\/p>\n<p>Just like anything else, some states are better than others.\u00a0 My own, unfortunately, is one of the worst, only requiring children to be properly restrained through the age of 5 and allowing the use of a booster starting at age 3, HOWEVER, the most important part of the lack-luster law is the part stating any person transporting a child is responsible for \u201cproperly using\u201d a child restraint.\u00a0 Many states have proper use laws meaning you must use your child restraint per the manufacturer guidelines.\u00a0 For example, the car seat Sugarplum currently uses in hubby\u2019s car (Safety 1<sup>st<\/sup> OnSide Air&#8211;pictured below) requires a child to be over 1 year, 22 pounds AND 34 inches to forward face meaning she could not have LEGALLY (not to mention safely) forward faced in her seat until she was over 2 because she was not yet 34 inches or 22 pounds. \u00a0(At 3 she was only 36&#8243;
